Compensation in case of accidents with serious injuries

An accident can happen in the blink of an eye, and the consequences for the person involved’s health and financial situation can be serious.

What compensation are you entitled to in Italy in the event of an accident resulting in serious injuries?

From March 2025, compensation for personal injury in cases of disability ranging from 10% to 100% will be calculated throughout Italy on the basis of the new single national table, the ‘TUN – Tabella Unica Nazionale’. The amounts are relatively high.

The legal provision originally provided for its application only in cases of disability resulting from road traffic accidents or medical negligence.

Extension to all types of accidents through case law:

In a judgement handed down in 2026, the High Court of Cassation established the legal principle that the ‘TUN’ has general validity, as it contains calculation criteria laid down by law.

What are the consequences of this interpretation?

The ‘TUN’ can now be applied by the courts to all accidents with serious consequences, regardless of their cause, even if they occurred before March 2025.

Its application is therefore universal, and there is greater legal certainty.

However, the person concerned must take the initiative and claim compensation for damages from the party responsible.
